PCS welcomes ESMA, Amundi and Freshfields
PCS welcomed on Friday 16th May, the European Securities and Markets Authority (ESMA) as a Permanent Observer and Amundi and Freshfields as new Members of the PCS Association.  ESMA joins the European Banking Authority (EBA) as a Permanent Observer to be the second European regulatory body to sit on the PCS Association’s meeting.  On the same day, Amundi – with close to € 800billion of assets under management, the first ranking European asset manager- and Freshfields, one of the world’s preeminent law firms, also became members.  This felicitously coincided with the award by PCS of its 50th label to a transaction originated by Nationale-Nederlanden […]

Senior IMF official supports the ECB/BoE approach to high quality securitisation
In the first sign that, following the ECB/Bank of England paper, the debate over the regulatory treatment of high quality securitisation is obtaining a foothold on the global agenda, Jose Viñals, a senior IMF official, spoke favourably of the approach championed in the joint communication.  His comments were made in an interview with Borsen Zeitung and picked up by Reuters.  (The Reuters piece may be found here and the original interview in German may be reached through here - but is behind a pay wall).

Joint ECB-Bank of England paper on securitisation is published
Today, the Bank of England and the ECB published the recently announced joint paper on securitisation.  The paper supports strongly the value of high quality securitisation.  Acknowledging the many macro-economic reasons for the low level of current European issuance, the paper also identifies the need to incorporate in the proposed regulatory schemes a single definition of high quality securitisations and to calibrate the prudential rules based on the actual performance of such securitisations.  Reflecting arguments that PCS has been putting forward since its inception, we strongly welcome this short but focused and to the point contribution.  What makes this paper all […]

PCS responds to the European Commission request for comments on the Liquidity Cover Ratio
Following a general request from the European Commission, the PCS has sent its response to the EBA's report of December 2013 on the definition of High Quality Liquid Assets (HQLA) that may be included in a bank's liquidity cover ratio buffers.  In the report, and following the lead of the Basel Committee on Banking Supervision, the EBA did not admit any securitisations as HQLA save a sub-set of RMBS.  PCS felt that there were a number of fundamental issues with the approach adopted by the EBA as well as some flaws in the methodological choices which combined to discriminate  unfairly against […]

European Commission requests the advice of the EBA on "high quality securitisation"
The European Commission has stated that it had put a formal request for advice with the European Banking Authority for the authority's views on the possibility of defining a category of "high quality securitisations" to be used in banking regulations.  This could presage the possibility of the various banking regulations mandated by the CRD and the CRR following a similar approach to that outlined in the recent EIOPA report on the capital requirements for insurance companies.  In its recent proposals, EIOPA defined a high quality securitisation category with lower capital requirements.  This approach, which PCS has long advocated, opens the […]

Following the European Commission, the Bank of England indicates its support for a revival of the securitisation market
Today, hot on the heels of the European Commission's very positive communication on securitisation, Dame Clara Furse of the Bank of England gave a speech where she stated that the Bank would "assess and, where necessary, act to promote a better functioning securitisation market in the United Kingdom".  This adds further support for the new consensus which appears to have emerged amongst policy makers across Europe in favour of a strong return of a high quality securitisation market.  The Bank of England link may be found here (with a link to the full speech) and the Reuters coverage here.

EU Commission publishes a communication on long-term financing: strongly supportive of high quality securitisation and harmonising regulations
Today, the EU Commission published its communication on long-term financing.  Both this document and Commissioner Barnier in his press conference put strong emphasis on reviving the securitisation market.  Even more importantly, the document identifies the need to craft a definition of high quality securitisation and to harmonise all the relevant regulations around this definition.  This is a position that PCS has long advocated and strongly welcomes.  It matches very closely both the work that PCS does and its mission.  We urge all stakeholders in the securitisation market to rally behind this approach that now has clear support from policy makers […]

European Commission holds public hearing on LCRs - negative signalling on securitisation
Yesterday, March 10th, the European Commission held a public hearing in Brussels on the leverage ratio and LCRs.  The meeting was attended by over 200 stakeholders.  On the much raised issue of the inclusion of securitisations in the definition of high quality liquid assets, the Commission said it was open to reviewing the matter, but also indicated that it was not minded  to change the position outlined in the EBA report.  Citing the desire to stick to the Basel recommendations, the Commission also indicated that it was aware of the arguments that had been raised over the EBA's report and […]

In an article today entitled "Draghi seeks to revive reviled loan bundles to boost credit", the Financial Times speaks of the desire expressed by President Draghi to see a return of high quality securitisation.  The article may be found here (although it lies behind a pay wall).

Financial Times articles sounds the alarm on European securitisation volumes
In an article published today, the Financial Times reports on 2013 securitisation issuance volumes published by the Association for Financial Markets in Europe (AFME).  These showed another marked decline especially compared to the strongly recovering US figures.  The article recalls the PCS warning of a few months ago that one cannot rule out a market implosion if volumes continue to drop. These worrying figures underline the increasing gap between the wishes of European policy makers to see securitisation assist in funding a European recovery and the facts on the ground.  The article can be found here (behind a paywall)

The PCS Secretariat is pleased to announce that the first PCS labels have been awarded for securitisations with Spanish assets. The two transactions have Spanish corporate loans and consumer loans respectively as their underlying assets

European Banking Authority becomes a Permanent Observer to the PCS Association
Today, the European Banking Authority (EBA) became a Permanent Observer of the Prime Collateralised Securities Association, representing the first regulator to do so and a further sign of high-level European institutional support for the securitisation industry. The EBA will join other observers, such as the European Central Bank (ECB), the European Bank for Reconstruction and Development (EBRD), the European Investment Bank (EIB) and European Investment Fund (EIF) and KfW in providing input to future PCS meetings and decision-making.  PCS is delighted and honoured by the EBA's decision and looks forward to obtaining the benefit of their insight in its deliberations.

Euroweek article: "Regulators must act on securitisation before it is too late" citing PCS as a possible solution
Euroweek published an article entitled "regulators must act on securitisation before it is too late".  The article examines President Draghi's comment in Davos about the lack of securitisation issuance and the role of regulation in this state of affairs.  Speaking of the need for a definition of high quality securitisation, it cites the PCS initiative as an example of how this can be achieved and quotes PCS' statements at the Las Vegas US securitisation conference.  It also ties the issue of securitisation with that of the rebalancing of the European financial system away for the crushing preponderance of banks.  The […]

Financial Times reports Draghi's Davos comments
The Financial Times reported Mr Draghi's comments on securitisation at the Davos meeting.  The FT focused more on the possibility of purchases of securitisations by the ECB than on the need for regulations to define high quality securitisations in order for the market to return.  It seems to PCS that Mr Draghi was primarily musing on the possible nature of a European QE in view of the legal prohibition for the ECB to effect outright purchases of sovereign debt.  One possibility mentioned was securitisation but, here, the problem foreseen by Mr Draghi was the simple fact that there was insufficient […]

Draghi calls for regulation to distinguish between good and bad securitisation to revive the market
In his contribution to the panel on the "Global Economic Outlook" in Davos on Friday 25th January, Mario Draghi spoke about possible actions of the ECB.  He strongly hinted that the ECB could buy securitisations but noted that the market, at present, was basically "dead".  However, he also stated that if regulations could distinguish between good and bad securitisations, the market may return.  This indicates an ever increasing held view, amongst European policy makers, that the key to a return on the securitisation market lies, of necessity, in the bifurcation in regulatory frameworks between high quality securitisations and others.  This […]

Banque de France supports RMBS as a way to counter bank deleveraging
In an article published on January 20th, l'AGEFI quotes the governor of the Banque de France, Christian Noyer, supporting the growth of a French RMBS market.  The rationale put forward by Mr Noyer is that only securitisation can remove mortgages (and other assets) from the balance sheet of French banks. The conference Securitisation – a must for growth and capital management?, hosted by Vieira de Almeida (VdA) and Prime Collateralised Securities (PCS), will take place at VdA’s premises in Rua Dom Luís I, 28, LISBOA, on May 20th, between 8:30am and 5:30pm.

The event will be devoted to the securitisation market in Portugal as well as across Europe including a look at current trends and possible future developments. It will explore the benefits of securitisation, as a financing source but also as a crucial technology to manage proactively regulatory and economic capital. The event will be a chance to meet securitisation experts, regulators, originators, arrangers, investors and servicers, discuss market trends and build relationships. It is aimed at anyone currently involved in the securitisation market or thinking of becoming involved, whether intending to securitise existing portfolios, investing, using or providing warehousing or synthetically managing capital. Whether working for a bank, a loan provider, a leasing company, an originator of broadcasting rights, a public utility including energy generation and telecom company, or if you are or are thinking of participating in the structured finance market, this event will be of interest.

As the year winds up, there will be many presentations looking into 2022 and seeking to map out the course of European securitisation in the coming months. They will focus on the many securitisation specific developments we can anticipate for next year.

In our “Quo Vadis?” webinar, PCS will seek to look both a little further and a little wider to reflect on the forces that may impact the European securitisation market not only in 2022 but beyond, from ESG to Basel 3, and how these may interact with each other.

The original answer to the question “quo vadis?” was, of course, grim and we hope that the European securitisation market can avoid the fate of the man who originally asked it.
